Pursuant to article 13 of the EU Regulation 2016/679 (hereinafter referred to as GDPR) regarding the protection of personal data, we herewith inform you that the personal data collected, regarding contractual relations established or a simple request for information, shall be the basis for data processing in compliance with the aforementioned standard and we herewith provide you the following information:
PERSONAL DATA COLLECTED
The personal data collected, upon your express and free consent, regard exclusively:
– identification data (for example: name, surname, address, phone number, fax, e-mail, etc…)
– tax data (if required by law – for example tax identification number, VAT registration number etc…)
DATA CONTROLLER AND SUPERVISOR OF PERSONAL DATA PROCESSING (13.1 a, b)
The personal data processing controller is SAU S.p.A. – Via Dei Raseni, 6/B Polinago – 41040 Modena (MO). The role of data processing supervisor is entrusted to Angelo Benassi to whom the party involved can contact at any time using the email address firstname.lastname@example.org or by phoning 053647510 regarding the exercising of rights referred to in article 13.2 letters b, c, d.
PERSONAL DATA PROCESSING PURPOSE AND METHOD (13.1 c)
The purposes for processing personal data are the following:
1) fulfilment of legal requirements relating to the contractual relationship;
2) the organisational management of the contractual relationship;
3) to fulfil the request submitted to us;
Personal data will be processed in paper, computerised and electronic form and entered in the relevant databases to which only the controller and his/her appointees are allowed to access. Regarding electronically processed data, all the appropriate safety measures are taken to protect the rights, freedom and legitimate interests of the party involved as per article 22.3 of the GDPR.
POSSIBLE RECIPIENTS OF PERSONAL DATA (13.1 e, f)
In relation to the purposes mentioned in points 1, 2 and 3, previous paragraph, data can be communicated to the following persons or categories of persons listed below:
– Recognised accountants offices relating to the professional assistance of companies when the communication is required by law or in the interests of the party involved (an individual or legal person or entity);
– Recognised lawyers offices relating to the professional assistance of companies when the communication is required by law, duly appointed for this kind of processing in full compliance with current measures or when the communication is in the interests of the party involved.
Moreover, the controller communicates that he/she does not intend transferring the data to a third non EU country or to any international non EU organisation.
DATA RETENTION PERIOD (13.2 a)
At the end of the service, of the supply of the service or of the answer, the personal data will be retained only for historical and statistical purposes in compliance with the law, with regulations, with the community standards and with the codes of professional ethics and conduct/practice in compliance with article 40 of the GDPR, for a period as per the existing law (normally 10 years), or for no longer than five years if they are not subject to any law. The personal data will either be retained in an anonymous form or destroyed after this period has elapsed.
RIGHTS OF THE PARTIES INVOLVED (13.2 b)
In relation to the aforementioned processing, the party involved has the right to access his/her personal data to amend or delete them or to limit their processing or to object to their processing, besides having the right to data portability.
RIGHT TO REVOKE CONSENT (13.2 c)
If processing is based on consent, the controller informs the party involved that he/she has the right to revoke it at any time without compromising the legality of processing based on consent given prior to being revoked.
RIGHT TO LODGE A COMPLAINT (13.2 d)
The controller shall inform the party involved of his/her right to lodge a complaint with a supervisory authority; in which case the former must ask the party involved for information using one of the systems mentioned above in order to contact him/her.
COMPULSORY OR OPTIONAL NATURE OF PROVIDING DATA (13.2 e)
Providing data and their processing are compulsory for tax reasons and as a result a refusal to provide them for these reasons could mean that the controller is unable to proceed with the professional relations or fulfil the legal requirements. In all the other cases, the providing of data and their processing is optional and there are no consequences.
POSSIBLE EXISTENCE OF AN ANUTOMATED DECISION-MAKING PROCESS (13.2 f)
The controller informs the party involved that there is no automated decision-making process on this site which means there is no profiling system.
Profiling cookies are not used on this site as established by the Provision issued by the Italian Data Protection Authority dated 8th May 2014 “Simplified Arrangements to Provide Information and Obtain Consent Regarding Cookies”, for transmitting information of a personal nature, neither the use of persistent cookies of any type (user tracking systems).
